For a society to acquire legal status it must be registered in accordance with Section 4 of the Act.
It is an offence under Section 4(1) of the Societies Act to manage, or assist in the management of, an unlawful society. Ensure your society is registered.

The Registrar of Societies is a Department under the Office of the Attorney General that deals with registration of societies in Kenya.
For a society to acquire legal status it must be registered in accordance with Section 4 of the Act. Societies in Kenya include; charitable societies, private member clubs, churches, welfare societies, political parties etc. They must be registered under the Societies Act (Cap 108) for them to be functional. Under section 8, the Registrar of Societies in Kenya is appointed and this includes the assistant and deputy registrar.
A society will not function if they don’t have an authorization from the Registrar, this means if the society takes contribution or donation from its members then it will be considered unlawful.
